Jason Veny presents at ABA committee

Jason Veny addressed the application of the Wright Line analysis at the Committee on Development of the Law Under the NLRA (DLL) Midwater Meeting in Kauai, Hawaii.
In Wright Line, 251 NLRB 1083 (1980), the Board established a burden-shifting analysis to be used in examining "'causality,' that is, the relationship between the employees’ protected activities and actions on the part of their employer which detrimentally affect their employment."
Jason addressed the application of the Wright Line analysis, recent Board decisions that address the General Counsel’s burden, and the General Counsel's 2021 memo which instructed NLRB Regions to submit "Wright Line" cases to the NLRB Division of Advice.
