EDVA Approves Settlement in FLSA Meal Break Case

Magistrate Judge Buchanan in the U.S. District Court for the Eastern District of Virginia today approved a settlement in Mendoza v. Cardinal Multi Services. The case sought to recover unpaid wages for work allegedly performed during sham meal breaks and before shifts on behalf of a group of construction workers.  The complaint also alleged that Defendants misclassified workers as independent contractors in violation of the Virginia Wage Payment Act.

The parties reached a settlement of $100,000 for nine workers, including lost wages and attorneys’ fees. The recovery is equal to nearly one hour of pay for each day of work that each plaintiff worked for the company.
