Murphy Anderson's Winning Streak in Defending Taft-Hartley Health Funds
Joni S. Jacobs, Murphy Anderson's employee benefits group leader, is continuing a winning streak in defending Taft-Hartley health fund clients in litigation brought by providers and participants.
In the past year, seven cases were brought by providers or participants asserting state-law claims that were preempted by ERISA, and without exhausting internal plan appeals procedures. All seven cases have been dismissed, either voluntarily or by court order, without the health funds paying anything to the plaintiffs.
These victories help preserve limited fund assets for the hard-working participants.
