Battery Wharf workers win strike after First Amendment fight

Michael Anderson represented UNITE HERE Local 26 in its successful 79-day strike at the Battery Wharf Hotel.

The strike settlement followed an injunction action in Massachusetts Superior Court seeking to expel union picketers from sidewalks around the Hotel. Michael argued that picketers had a First Amendment right to be on the public easement.

After the plaintiff condominium owners were unable to win an immediate injunction, the Hotel agreed to a settlement on Nov. 22 in line with the Union’s city-wide contracts.
