Murphy Anderson’s Mark Hanna in Market Watch on Return to Office Law

At-will employees don’t have a lot of options when employers change return-to-office requirements, Murphy Anderson partner Mark Hanna said in a MarketWatch article.

Exceptions include when an employee is represented by a union and if remote work is necessitated by a disability accommodation.  Hanna also argued that some employers may have created contractual liability for workers if offer letters spelled out remote work terms. 

Notwithstanding the limited legal options most employees have, Hanna confirmed that the issue of remote work is “is an increasingly common point of contention between workers and management.”

Employees real leverage, especially in this tight labor market, is that they can seek to find another job that allows them to work remotely.
